LiveAsk Website Terms of Use

These Terms of Use apply to your use of the LiveAsk website and its public-facing features, including LiveAsk.

They are website terms. They do not replace any separate proposal, service agreement, Agent/Implementer agreement, reseller agreement or other contract entered into for paid LiveAsk services.

1. Using this website

You may use the LiveAsk website for lawful purposes, including learning about LiveAsk, interacting with LiveAsk and making a genuine business enquiry.

You must not intentionally misuse the website or LiveAsk, interfere with their operation, attempt unauthorised access, submit malicious material, impersonate another person, or use the service for unlawful, abusive or fraudulent activity.

2. LiveAsk and AI-generated responses

LiveAsk is an AI-powered conversational system.

It is designed to help visitors obtain relevant information and, where appropriate, identify useful next steps or make contact with a business.

AI-generated responses can be incomplete, inaccurate or misunderstood. Information supplied through LiveAsk is provided for general website and enquiry purposes and should not be treated as professional legal, financial, medical or other specialist advice.

Where an answer materially affects a purchasing or business decision, you may ask for human clarification.

8. LiveAsk outcomes

Individual visitor behaviour and business outcomes vary. Unless expressly agreed in a separate written contract, LiveAsk does not guarantee a particular enquiry volume, lead volume, conversion rate, sale, revenue outcome or other business result.

9. Liability and Australian consumer rights

Nothing in these Terms is intended to exclude, restrict or modify rights or remedies that cannot lawfully be excluded under applicable Australian law, including applicable consumer guarantees.

To the extent permitted by law, LiveAsk is not responsible for loss caused solely by reliance on an AI-generated answer without reasonable verification, misuse of the website, unauthorised activity, or circumstances outside LiveAsk's reasonable control.

Any more specific liability allocation applying to paid services should be set out in the relevant service agreement.

10. Privacy

Use of personal information is governed by the LiveAsk Privacy Policy.

11. Governing law

These Terms are governed by the laws applicable in Queensland, Australia. You submit to the jurisdiction of the courts of Queensland and courts entitled to hear appeals from those courts, subject to any rights that cannot lawfully be excluded.
